What age do courts take child's opinion into consideration?


My 5 y.o. daughter recently told me she'd rather live with me than her mom. Her mother lives in a motel, where it's her, My daughter, mother's boyfriend, and boyfriends 2 kids. None of the kids have beds, mother barely pays attention to her, and smokes so heavily My daughter needs a nebulizer any time she gets a cold. I own a house, she has her own room, I have reliable child care when I'm at work. How can I make this happen for my child?

Depends on the state but it's usually around the age of 12. My daughter was able to in Montana and she was 10 at the time. My son couldn't here in California until he was 12.

Some courts wait until the child is around 10 or 12 I believe.

It depends on the state. I know Illinois and Iowa the age is 10

I really hope you've sorted things out already, but in Ohio at least, they take the child's wishes into consideration, but place them as the court sees fit. It's also illegal here to smoke with your daughter like your ex is. Good luck, sir

In NYS it is 12 for a “normal” child, but it can vary depending on mental maturity.

First you must get a case worker out there to investigate and also if you can get a recording as mean as it may sound but you must do what you must do for your child well being. Every start it different. Massachusetts is age 14. Get a doctor involved as well for medical reasons. Do it by the book and you should be good.
